TERMS AND CONDITIONS

  1. One Application Form can be used for booking of one Commercial/Residential Unit.

  2. All applicants will attach photocopy of CNIC/Overseas National Identity Card/Passport Size Photographs.

  3. All payments are to be made according to the category of Unit, as per schedule of payments, through Demand Draft/Pay Order, online payment, in favor of “Sultan Marketing”.

Complete particulars of applicant should be endorsed on the backside of Demand Draft/Pay Order. All payments made shall be subject to Anti Money Laundering checks as envisaged by law.

  1. The applicant undertakes to enter into a Sale and Purchase Agreement (SPA), also known as “Contract Sale”, with Sultan Marketing, whereby the applicant shall pay a total down payment/deposit of 30% of the purchase price.

  2. Complete payment plan will be provided at the time of booking. Installments are payable according to the provided schedule. If any installment is received after the due date, a surcharge will be imposed in addition to the installment amount.

  3. If the applicant fails to pay three consecutive installments/payments or does not follow the payment plan, the allotment shall be cancelled after the third and final notice.

  4. In case of default/cancellation, 20% of the deposited amount shall be deducted as a cancellation fee. The remaining amount will be refunded in installments after completion of the project.

  5. No applicant shall claim or be paid any profit, interest, or markup against the amount paid, even if the unit is surrendered/cancelled.

  6. The price is based on the assumed standard size of the unit. However, payments will be calculated on actual measurements, and the applicant may have to pay more or less according to the allotted size at the time of possession.

  7. No further construction can be done without approval of DHA Islamabad, and the Residential/Commercial Unit shall not be used for any purpose other than that for which it was applied.

  8. Management Committee reserves the right to alter or cancel allotment due to non-payment. The applicant shall have no right to such unit after cancellation. The decision of the Management Committee shall not be challenged in any forum.

  9. The applicant shall pay defined escalation charges in case of unexpected increases in the cost of raw materials utilized for development due to events beyond reasonable control, including but not limited to:
  • Acts of God
  • Earthquakes
  • Storms
  • Floods
  • Epidemics
  • Explosions
  • Fire
  • Chemical contamination
  • Radioactive contamination
  • Civil commotion
  • War
  • Sabotage
  • Government instability
  • Armed conflict
  • Terrorism
  • Judicial/quasi-judicial/executive actions
  • Policy changes

(“Force Majeure Event”)

  1. The applicant will pay all taxes and other charges levied by Federal/Provincial Government, DHA Islamabad, Local Bodies, Municipal Bodies, or any other authorities, whether existing or imposed in the future.

  2. Other Possession & Documentation Charges and miscellaneous charges, including electricity connection, gas connection, security charges, maintenance charges, etc., shall be applicable after completion and possession of the project.

  3. Every applicant shall abide by these terms and conditions in addition to the bylaws, rules, and regulations governing allotment, possession, ownership, construction, and transfer of property, as applicable and enforced from time to time by DHA Islamabad.
